SERVICE

These Terms of Service ("Terms") form a legally binding agreement between you ("User," "you") and Souhail ZAKI, a French micro-entreprise operating under the Ascend AI brand ("Ascend AI," "we," "us"). By downloading, installing, or using the Ascend AI application or any related services (collectively, the "Service"), you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, you must not use the Service. We may update these Terms at any time; continued use after changes constitutes acceptance.

Ascend AI is an AI-powered facial analysis application that provides:

• Scan-based scoring based on algorithmic assessment of submitted photographs
• Looksmax guidance and diagnosis features
• Premium plan access and premium content
• Progress tracking and account-linked results

Ascend AI does not recommend, endorse, or facilitate surgical procedures, medical treatments, or prescription medications. For health concerns, consult a qualified professional.

You must be at least 18 years of age to use the Service. By using it, you represent that you meet this requirement, have the legal capacity to enter a binding agreement, and that your use complies with all applicable laws in your jurisdiction.

You may register using Google OAuth or Sign in with Apple. You agree to provide accurate, complete information and to keep it current.

You are solely responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorized access. We are not liable for losses from unauthorized use of your account.

Creating multiple accounts to manipulate scores, circumvent restrictions, or for any fraudulent purpose is prohibited and may result in immediate termination of all accounts.

Ascend AI offers a free tier including account creation, onboarding, a 3-angle scan flow, a baseline score, limited app access, and standard sign-in / sign-out functionality. No payment is required for the free tier.

Premium is available on a monthly basis at $9.99/month. Annual billing is not currently offered. Premium unlocks detailed diagnosis, premium score breakdown, plan access, tracking features, premium content, and restore purchases.

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period, subject to App Store rules. Payment and subscription management are handled through Apple App Store and RevenueCat. You may cancel at any time; access continues until the end of the paid period.

Refunds are handled by Apple according to App Store policies. We do not provide a separate contractual refund window outside applicable store rules.

We will provide 30 days' advance notice via email before any price changes. Continued use after the notice period constitutes acceptance.

You agree NOT to:

• Upload photos of anyone who has not given explicit consent
• Upload photos of anyone under 18 years of age — for any reason
• Use the Service to harass, humiliate, or demean others based on their appearance
• Share scores or analysis to publicly degrade or bully other individuals
• Attempt to reverse-engineer or extract our AI models or algorithms
• Use automated tools to scrape or bulk-access the Service
• Attempt to access other users' data or circumvent security measures
• Use the Service for commercial purposes without our written consent
• Create derivative products based on our analysis output without permission
• Violate any applicable laws or regulations in your jurisdiction

You retain all ownership rights to photographs you submit. By submitting a photo, you grant Ascend AI a limited, non-exclusive, royalty-free license to process that image solely for generating your analysis. This license terminates when the image is deleted under our retention policy, and in any case within 24 hours.

By submitting a photo, you confirm that you are the person in the photo (or have that person's explicit written consent), the person is at least 18 years old, and submission does not violate any third party's rights.

Appearance-focused applications can affect mental wellbeing. If you experience distress related to body image or self-esteem, we encourage you to stop using the Service and consult a qualified mental health professional. If you are in crisis, please contact a crisis helpline in your country immediately.

To the extent permitted by applicable law, our total liability is limited to the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Ascend AI and its officers, directors, employees, and agents from and against any claims, damages, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, your violation of applicable law, or your submission of content that infringes third-party rights.

All content, features, and functionality of the Service — including algorithms, interface design, brand marks, and text — are owned by Souhail ZAKI or licensed for use by Ascend AI and protected by applicable intellectual property laws. The "Ascend AI" name and logo are our brand assets. You may not copy, modify, distribute, or use our intellectual property without express written permission.

You may request account deletion from within the app. This is permanent and irreversible. Account-linked data is deleted or anonymized within 30 days. Active subscriptions continue until the period ends and are not prorated.

We may suspend or terminate your account immediately for violating these Terms, engaging in fraud, or causing harm to other users or third parties. Sections 8, 9, 10, 11, and 13 survive termination.

These Terms are governed by the laws of France. Users may retain mandatory consumer protections under applicable law.

We encourage informal resolution first — contact support@acsndai.com. If unresolved within 30 days, disputes may be brought before the competent courts in accordance with applicable law. We do not require binding arbitration.

• Entire Agreement: These Terms and the Privacy Policy constitute our complete agreement
• Severability: If any provision is unenforceable, the rest remain in effect
• No Waiver: Failure to enforce any provision is not a waiver of future enforcement
• Assignment: We may assign these Terms in a merger or acquisition. You may not assign without our consent
• Language: English is the controlling language in case of translation conflict
